Welcome to americanhighschool.org! To access and utilize our website, courses, and services, you will be utilizing our intellectual property and technology for your benefit. In order to protect our property and ensure proper use of the website, courses, and services, we reserve certain rights and have the ability to impose limitations. We have responsibilities to you, and you, in turn, have responsibilities to us. Collectively, these rights and responsibilities are referred to as the “Terms of Use” (or “Terms”). By using our Services (defined below), you agree to adhere to these Terms. Therefore, it is essential that you carefully read this entire page before using AHS’s Services.
If you are under the age of 13, you may not use the Services unless you have obtained the agreement of your parent or legal guardian.
Additional terms may apply to certain features of the Services, and these will be posted in connection with such features. Such additional terms are considered part of these Terms of Use and are legally binding, similar to if they were included on this page.
Please note that these terms require the use of arbitration on an individual basis to resolve disputes, and do not permit jury trials or class actions. Furthermore, these terms also place limitations on your remedies in the event of a dispute.
Definitions
FERPA
Refers to the Family Educational Rights and Privacy Act of 1974 (20 U.S.C. § 1232g; 34 CFR Part 99) (“FERPA”) and similar laws governing the disclosure of student information.
AHS
American High School LLC. and its subsidiaries and Affiliates.
Affiliate
An “Affiliate” of American High School LLC. refers to an entity that, directly or indirectly, controls American High School LLC., is controlled by American High School LLC., or is under common control with American High School LLC. The term “Control” means having the power to directly or indirectly influence the management policies of an entity.
Sensitive Information
Refers to:
- personally identifiable information as defined in FERPA.
- educational records, as defined in FERPA.
- pupil records as defined in the California Education Code section 49073.1 and similar laws.
- covered information as defined in Student Data Privacy Laws.
Services
Refers to AHS’s Sites, software, products, mobile applications, and services.
Sites
Refers to AHS’s websites, including those owned, operated, or controlled by AHS, where the Services are made available.
Student Data Privacy Laws
Refers to laws that specifically protect the use and disclosure of electronic student records and information coming from those records.
User Content
Refers to all information and content (including text, photos, images, sound, video, and any other materials) that a user submits to the Services.
Services
AHS provides a range of Services, including courses, lessons, evaluations, communication tools, tracking tools, directories, event offerings, and opportunities to communicate with others through the Services. The Services also encompass communications from AHS, such as service announcements, administrative messages, and other relevant messages. Please note that AHS reserves the right to modify, add, or remove features of the Services periodically. These Terms of Service apply to all such changes and additions.
Account Registration and Responsibilities
To access certain Services, you are required to register for an account (“Account”) and provide accurate and up-to-date information about yourself and/or your child. It is essential that you always provide true, complete, and current information for your Account. Additionally, please note that you must meet the legal age requirement (usually 18 years old) to create an account. If you wish to deactivate your Account, you can do so at any time by following the instructions provided on the Site.
If you are adding a student to your Account, you acknowledge and certify that you are the parent or legal guardian of the child listed on the Account. As the parent or legal guardian, it is your responsibility to assess and determine whether the Services are appropriate for your child.
Maintain the privacy of your password. You are solely responsible for any activity that occurs on or through your Account. It is important not to use your Account password for other websites or applications. In the event of any unauthorized use or suspected unauthorized use of your Account, or if you become aware of any security breach, it is your responsibility to promptly notify AHS.
Please remember to keep your Account information secure and properly safeguarded to prevent unauthorized access or misuse.
Requirements and Restrictions for Use of the Services
How You Use the Services: We grant you a non-transferable, limited license to access and use the Services solely for your personal use. Please note that this license can be revoked by us at any time. It is important to understand that you do not have the rights to:
- Modify or use our content for any other purposes.
- Communicate or publish our content to third parties, including the general public, acquaintances, or other businesses and entities.
- Record, photograph, or stream our content.
- Post our content on any website or social media platform.
- Sell our content.
- Engage in any actions that infringe upon our intellectual property rights, including using our content to develop another product or service.
Ownership: With the exception of User Content, all content within the Services, including text, graphics, data, photographic images, moving images, sound, drawings, and software, is either owned by AHS or licensed by AHS from third parties. All content within the Services is protected by copyright, trademark, patent, and other laws relating to the protection of intellectual property. Please note that you do not own any User Content, except for the content that you have personally submitted.
Access: It is your responsibility to obtain access to the Service. You must provide and be responsible for all equipment necessary to access the Service. However, if you are enrolled in a public school for which AHS provides services and that school has provided you with the necessary equipment and/or partially or fully reimbursed access fees, you will not be held responsible for any associated fees or equipment obligations.
Framing
You may not frame or utilize framing techniques to use, surround, or enclose any portion of the Site without AHS’s express written consent.
Responsibilities as a Parent or Legal Guardian
As the parent or legal guardian of the student, you have certain responsibilities regarding their education and internet access. These responsibilities include:
- Ensuring the student’s true attendance is properly logged.
- Participating in parent/student meetings as required.
- Maintaining equipment and materials provided by AHS or the student’s school in good condition.
- Understanding that computers or hardware provided to students may have filtering software to restrict access to objectionable internet sites. However, AHS does not guarantee the effectiveness of this software.
- Taking responsibility for monitoring and managing the student’s use of the webcam.
- Promptly returning any computers or hardware provided by AHS when requested to do so. Failure to do so may result in AHS disabling some or all use of the computer or hardware.
Requirements for Users Under the Age of 13
The Children’s Online Privacy Protection Act (“COPPA”) mandates that AHS obtain parental permission before knowingly collecting Sensitive Information from children under the age of 13. AHS does not knowingly collect or request any Sensitive Information from children under 13, except directly from a child’s parent or guardian or through the child’s utilization of the Services as a student in a school using AHS Services.
In the event that we become aware of any Sensitive Information collected from a person under 13 that is not in compliance with COPPA, we will promptly delete that information. If you believe that a child under the age of 13 has provided Sensitive Information to us without the knowledge and consent of their parent or guardian, kindly contact us at [email protected].
Service Modifications and Support:
Modification: AHS reserves the right to change, suspend, add to, or discontinue some or all of the Services at any time, with or without prior notice to you. Please note that AHS shall not be held liable for any changes, suspensions, additions, or discontinuation of any of the Services.
No Support or Maintenance: AHS is under no obligation to provide any support or maintenance for the Services. However, it is important to note that this limitation does not apply to any support or maintenance services that the school in which your student has enrolled has specifically contracted with AHS to provide.
User Content: You are solely responsible for any content you post or submit as User Content. It is your responsibility to ensure that your User Content has not been copied or altered from someone else without their permission. In the event that you post or submit something that may raise concerns, we may contact the appropriate authorities, such as the Police or Social Services, if necessary. You agree not to post any User Content that violates your school’s policies or guidelines regarding acceptable content.
Code of Conduct: You are prohibited from misrepresenting or suggesting that your User Content is provided, sponsored, or endorsed by AHS. AHS is not obligated to create backups of any User Content, unless required by law. As a result, your User Content may be deleted at any time without prior notice.
Use of Your Feedback: We appreciate receiving your feedback, ideas, or suggestions (“Feedback”) regarding our Services! We reserve the right to utilize your Feedback without any limitations or obligations to you, even after you cease using the Services, unless the Feedback is protected by FERPA or any applicable Student Data Privacy Laws.
How we Use User Content: Your User Content remains your own. These Terms do not grant us any rights to your User Content, except as explicitly stated. When you provide your User Content to us through our Services, you grant us (and those we work with) a worldwide license to use, host, store, reproduce, modify, publish, perform, display, and distribute that content. The rights granted to us are limited to the purpose of operating, promoting, protecting, and improving our Services, as well as developing new ones. If necessary for these purposes, we may provide User Content to other entities, but only under the condition that those entities adhere to the same restrictions as we do. This license persists even if you stop using our Services. However, the rights granted to us for your User Content are subject to compliance with FERPA and any other applicable Student Data Privacy Laws.
Enforcement: We reserve the right, but are not obligated, to review User Content, investigate, and take action at our sole discretion if you violate the Acceptable Use Policy described below, your school’s student code of conduct, or any other provision of these Terms. Such actions may include removal or alteration of your User Content, termination of your Account, reporting violations to your school for their code of conduct, and reporting you to law enforcement or other relevant authorities. We reserve the right to take these actions when necessary to protect ourselves or others from potential liability.
Accessibility
AHS is committed to ensuring that our Services remain accessible to all individuals, regardless of disability. We strive to provide an inclusive user experience. If you have a disability and have concerns regarding the accessibility of our Services, we encourage you to reach out to us to discuss your specific needs.
If you are a student or the parent/legal guardian of a student attending a school that uses our Services, please contact your school directly to discuss possible accommodations and related services that may be available.
We are committed to addressing accessibility concerns promptly and working towards finding suitable solutions to ensure equal access for all individuals. Your feedback and input are valuable to us as we continually strive to improve the accessibility of our Services.
Account Termination
These Terms are in full force and effect while you use the Services. AHS reserves the right to suspend or terminate your rights to use the Services, including your Account, at any time and for any reason, at its sole discretion. If such suspension or termination occurs, your Account and your right to access and use the Services will be terminated immediately. AHS shall not be held responsible to you for any consequences arising from the termination of your rights under these Terms.
Third-Party Services
Sometimes, the Services provided may include links to other third-party services, applications, and websites (collectively, “Third-Party Services”). Please note that these Third-Party Services have their own terms and policies, and your use of them will be governed by those terms and policies.
AHS does not have control over Third-Party Services and does not accept any liability for your use of such services. While AHS may provide access to Third-Party Services as a convenience to you, it does not review or make any representations regarding the content or functionality of Third-Party Services, except for those expressly included in courses.
Please ensure that you review and understand the applicable terms and policies of any Third-Party Services you access through our Platform. It is your responsibility to comply with the terms and policies of Third-Party Services, as AHS is not liable for any transactions, interactions, or issues related to Third-Party Services.
Export Control
Any software from this Site is subject to United States export controls and, potentially, the import laws of your jurisdiction. No software from this Site may be downloaded or otherwise exported or re-exported to any person or entity on the U.S. Treasury Department’s list of Specially Designated Nationals or the U.S. Commerce Department’s Table of Denial Orders or otherwise prohibited by United States export control laws. By downloading or otherwise using Software from this Site in any manner whatsoever, you represent and warrant that you are not on any such list or located in, under the control of, or a national or resident of any such country.
Any use of downloaded software by the U.S. Government, including but not limited to any Educational Institutions under its jurisdiction or under corresponding States’ jurisdiction, is subject to ‘restricted rights’ as that term is defined in FAR 52.227-19(c)(2) or DFAR 252.227.7013(c)(1) (if used in a defense-related agency).
User Content
Requirements for User Content

User Content, and Interactions
8.1. Each person using the Services is solely responsible for their own User Content.
8.2. AHS does not assume responsibility for any User Content, whether provided by you or others.
8.3. We make no representations or warranties regarding the accuracy, suitability, or quality of any User Content.
8.4. Your interactions with other users of the Services are solely between you and such users.
8.5. AHS does not accept any liability for any loss or damage resulting from such interactions.
8.6. In the event of a dispute between you and another user, AHS is under no obligation to become involved.
8.7. If the dispute arises from or is connected to a school, we recommend that you contact the respective school for resolution.
AHS’s Acceptable Use Policy
We expect you to behave responsibly when using the Services. The following examples provide an overview of prohibited behaviors:
Abusing and Disrupting the Services
1.1. Do not probe, scan, or test the weaknesses of any system or network.
1.2. Do not breach or bypass any security or authentication measures.
1.3. Do not access, tamper with, or use nonpublic areas of the Services without authorization.
1.4. Do not interfere with or disrupt any user, host, or network, including distributing harmful programs or overloading the Services.
1.5. Do not decompile, reverse engineer, or take apart any part of the Services.
1.6. Do not access or create accounts for the Services through unauthorized means.
1.7. Do not take any action that creates an unreasonable load on our systems.
1.8. Do not share your password or use someone else’s credentials to manage the Services.
1.9. Do not upload, transmit, or distribute computer viruses or software intended to damage or change computer systems or data.
Spamming and Phishing
2.1. Do not send spam or unsolicited communications, promotions, or advertisements.
2.2. Do not send altered, deceptive, or false source-identifying information, including phishing or spoofing.
Lying and Pretending to be Others
3.1. Do not post fake or misleading content.
3.2. Do not impersonate another person, company, or entity.
Stealing
4.1. Do not sell the Services without written approval from AHS or use the Services on unauthorized networks or systems.
Infringing, Misappropriating and Violating Rights
5.1. Do not infringe or misappropriate anyone’s intellectual property rights.
5.2. Do not violate anyone’s privacy or publicity rights.
5.3. Do not collect or gather information or data related to other users without their permission.
Harming Others
6.1. Do not post or engage in threatening, harassing, abusive, violent, offensive, harmful, defamatory, sexually explicit, pornographic, or obscene behavior.
6.2. Do not promote bigotry, violence, property damage, or hatred against any person or group.
Breaking the Law
7.1. Do not use the Services in violation of any US export controls or sanctions.
7.2. Do not engage in activities that violate local laws related to online conduct and acceptable content.
7.3. Do not provide support or resources to organizations designated as foreign terrorist organizations.
7.4. Do not use the Services if you are located in a country under US embargo or are on the US Treasury Department’s list of Specially Designated Nationals or the US Commerce Department’s Table of Deny Orders.
8.1. Each person using the Services is solely responsible for their own User Content.
8.2. AHS does not assume responsibility for any User Content, whether provided by you or others.
8.3. We make no representations or warranties regarding the accuracy, suitability, or quality of any User Content.
8.4. Your interactions with other users of the Services are solely between you and such users.
8.5. AHS does not accept any liability for any loss or damage resulting from such interactions.
8.6. In the event of a dispute between you and another user, AHS is under no obligation to become involved.
8.7. If the dispute arises from or is connected to a school, we recommend that you contact the respective school for resolution.
Trademarks
AHS, LLC and other names of AHS products and/or services, including on the Site, are the trademarks and service marks of AHS. AHS’s trademarks and service marks may not be used in connection with any product or service that is not AHS in any manner that is likely to cause confusion among users or in any manner that disparages or discredits AHS.
All other trademarks, service marks, and logos used on the Site belong to their respective owners. AHS does not make any claims to the marks of others that might appear on the Site.
Copyright
All content and materials available on the Site, including but not limited to text, graphics, logos, images, audio clips, video clips, articles, and software, are protected by copyright laws and are the property of AHS or its licensors.
Unauthorized use, reproduction, or distribution of copyrighted materials on this Site is strictly prohibited without the express written permission of AHS.
User-generated content, including comments, posts, and any other submissions, shall remain the property of the respective users. However, by submitting such content, users grant AHS a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media or medium, or any form, format, or technology now known or later developed.
In accordance with the Digital Millennium Copyright Act (17 U.S.C. 512), AHS, LLC is registered with the United States Copyright Office as a Service Provider.

Data Protection
Privacy Rights: AHS respects your privacy and is committed to protecting your personal information. Our Privacy Policy describes our privacy practices and obligations in detail. By using the Services, you acknowledge that you have read, understood, and agree to the terms of our Privacy Policy. It is important that you carefully review the Privacy Policy to understand how we collect, use, disclose, and protect your personal information. The Privacy Policy also explains your rights with respect to your personal information and how to exercise those rights.
Personally Identifiable Information and User Communications
Please note that American High School (AHS) takes the protection of personally identifiable information and submitted papers very seriously. We have rigorous measures in place to safeguard this information. However, excluding personal data, any communications or material of any kind that you email, post, or transmit through the Site, such as questions, comments, suggestions, and other data, will be treated as non-confidential and non-proprietary.
We refer to these communications as “Communications.” AHS reserves the right to use these Communications, royalty-free, for business purposes, including, but not limited to, the development and use of products.
While AHS may monitor certain areas of the Site for user Communications, such as chat rooms, bulletin boards, and user forums, we do not guarantee such monitoring. Third-party services, such as Turnitin, may also provide monitoring services, but they will have no liability related to the content of any Communications. These third-party services have the right to remove, at their discretion, any Communications that include material deemed abusive, defamatory, obscene, or otherwise inappropriate.
Liability
Indemnification
You agree to indemnify and hold harmless AHS, along with its employees, officers, and directors, from any costs, liabilities, losses, and damages (including legal fees) arising out of or related to:
(a) Your breach of these Terms of Service;
(b) Your User Content;
(c) Your violation of the rights of any third party; or
(d) Your use of the Services.
Limitation of Liability
If something bad happens as a result of your use of the Services, AHS’s liability is limited as described in this paragraph. AHS and its providers are not liable for anything related to the Services or these Terms for:
(a) Any direct, indirect, special, incidental, exemplary, punitive, or consequential damages;
(b) Any loss of profits, revenue, data, goodwill, or other intangible losses;
(c) Any damages related to your access to, use of, or inability to access or use the Services or any part of the Services;
(d) Any damages related to loss or corruption of any content or data, including User Content;
(e) Any User Content or other conduct or content of any user or third party using the Services;
(f) Any third-party sites accessed via the Services.
If you are dissatisfied with this Site or related services, please stop using the Site.
CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
Disclaimers
The Services are provided to you “as is,” without warranties, either express, implied, or by law. AHS disclaims any warranties to you of merchantability, fitness for a particular purpose, accuracy, and non-infringement. AHS does not promise that the Services will be timely, uninterrupted, secure, error-free, meet your requirements or expectations, or be free from viruses or other harmful components. If applicable law requires any warranties with respect to the Services, those warranties are limited in duration to sixty days from the date of first use. Some places don’t allow the disclaimers in this paragraph, so they may not apply to you.
Governing Law, Informal Resolution, and Arbitration
Governing Law and Location for Solving Disputes
Governing Law: Any disputes arising from or relating to these Terms of Service or the use of the Services shall be governed by the laws of the Commonwealth of Virginia, excluding its conflicts of law provisions.
Exclusive Location for Claims: The exclusive location for any claim or action arising from these Terms of Service or the use of the Services shall be the federal or state courts with jurisdiction in Fairfax County, Virginia.
Personal Jurisdiction: By agreeing to these Terms of Service, you consent to personal jurisdiction in the aforementioned courts.
Convenience of Location: You acknowledge and agree that the specified location for resolving disputes is not inconvenient.
Dispute Resolution
Informal Resolution: Before initiating any formal proceeding or filing a claim against AHS, you agree to try to resolve the dispute by first emailing legal[at]AHS.com with a description of your claim. AHS will make reasonable efforts to resolve the dispute informally by following up via email, phone, or other appropriate methods of communication.
Formal Proceedings: If the dispute cannot be resolved within thirty (30) days of AHS’s receipt of your initial email, you or AHS may then initiate a formal proceeding as described below.
Binding Arbitration
Please read this Arbitration Agreement carefully. It is part of your contract with AHS and affects your rights. Any dispute or claim relating in any way to these Terms (including to the validity and enforceability of the Terms) or the Services will be resolved through binding and confidential arbitration, rather than in court.
- Applicable Law: The Federal Arbitration Act and federal arbitration law will govern any arbitration conducted under these Terms.
- Arbitration Process: The arbitration will be conducted in English by the American Arbitration Association (AAA) under its rules, including the AAA’s Supplementary Procedures for Consumer-Related Disputes. The AAA’s rules are available atadr.org or by calling 1-800-778-7879. You may choose to have the arbitration conducted by telephone, based on written submissions, or in person. The arbitration will be held before one arbitrator selected through the AAA process.
- Awards and Relief: The arbitrator can award on an individual basis the same damages and relief as a court, including injunctive and declaratory relief or statutory damages, and must follow the Terms as a court would. The arbitrator’s written award and statement of decision will also include the calculation of any damages awarded.
- Individual Proceedings: Both parties agree that any dispute resolution proceedings will be conducted on an individual basis only and not as a class, consolidated, or representative action. If, for any reason, a claim proceeds in court rather than in arbitration, both parties give up their right to a jury trial.
- Intellectual Property Rights: Both parties agree that suit may be brought in court to enjoin infringement or other misuse of intellectual property rights.
Other Provisions
California Disclosure: If you are a California resident, you have the option to report complaints to the Complaint Assistance Unit of the Division of Consumer Product of the California Department of Consumer Affairs. You can contact them in writing at 400 R Street, Sacramento, CA 95814, or by telephone at (800) 952-5210.
Electronic Communications: The communications between you and AHS will be conducted using electronic means. This includes communication through the Site, Services, emails, and any statements or notices posted on the Services. By agreeing to these terms, you (a) consent to receive communications from us in electronic form, and (b) acknowledge that any terms and conditions, agreements, notices, disclosures, and other communications provided by us electronically comply with any legal requirement that such communications would satisfy if they were in a hardcopy writing.
Entire Agreement: These Terms constitute the entire agreement between you and AHS regarding the use of the Services. Any exception to these Terms is only valid if it is in writing and signed by an executive of AHS.
Third-Party Rights: These Terms are solely between you and AHS. No other person or entity has any rights to enforce any of the Terms.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect. An enforceable term will be substituted to reflect the intent of the parties as closely as possible.
Assignment: You may not transfer any of your rights and obligations under these Terms, and any attempt to do so is void. AHS, however, reserves the right to transfer its rights under these Terms to any of its affiliates or subsidiaries, or to any successor in interest of any business connected with the Services.
Modifications: AHS reserves the right to change these Terms at any time. The most current version of the Terms will always be posted on our Site. It is your responsibility to check back regularly for any updates. By continuing to use or access the Services after any changes come into effect, you agree to be bound by the updated terms. If you disagree with the changes, please discontinue your use of the Services.
